عقدنة العلاقة بين الدولة والمؤسسات العمومية الاقتصادية

The public economic sector is seen as a stone corner to the development of an adequate economy and an achievement of a standard economic development within the market economy. In order to enable an economic company to boost the development, it must be sufficiently independent to take its own appropriate economic decision. This independence relationship does work if it is not well defined with the State. The contract is the best tool for this.  In this article, we have dealt with the way the relationship between both parties has been conditioned by the contract, the particular character of the German company contract system as well as the possibility of putting it into practice by the Algerian economic public sector companies in order to free them from external constrains and confine their business to achieving economic output.

يعدّالقطاع العام الاقتصادي حجر الزاوية لبناء اقتصاد متين وتحقيق نمو اقتصادي متوازن في ظل اقتصاد السوق. ولكي تحقق مؤسساته دورها في دفع عجلة التنمية لا بد من أن تتمتّع بالاستقلالية الكافية لاتخاذ القرار الاقتصادي الملائم. ولن تتحقق هذه الاستقلالية إذا لم تحدّد علاقتها بالدولة بدقّة. ويعد العقد الوسيلة المثلى لتنظيم هذه العلاقة.  وفي هذا المقال عرضنا كيف تم تكريس إخضاع العلاقة بينهما إلى العقد والطابع الخاص لنظام عقود المؤسسات الألماني وإمكانية تطبيقه على مؤسسات القطاع العام الاقتصادي الجزائرية لتحريرها من الضغوط الخارجية وجعل نشاطها يرتكز على تحقيق المردودية الاقتصادية.

Le secteur public est le pilier économique d'une économie solide et une croissance économique équilibrée en économie de marché. Pour atteindre son rôle dans la promotion du développement les entreprises publiques doivent être suffisamment indépendantes dans la prise des décisions économiques. Cette indépendance ne serait atteinte que si sa relation avec l’état était organisée avec précision, le contrat est le cadre préférable pour cette organisation. Dans cet article, nous avons exposé  comment l’idée de la contractualisation  a été intégré dans le droit positif, et on a étudié le droit des contrats d’entreprise allemand et proposé une éventuelle application de cette expérience aux entreprises  du secteur public algérien pour atteindre sa  libération économique des pressions extérieures et aboutir à une  activité basée sur l'atteinte de la viabilité économique.
