تقويم مبدأ شرعية العقوبة في قضاء المحاكم الجنائية الدولية الخاصة

Abstract

The establishment of the International Criminal Tribunals for the former Yugoslavia and Rwanda showed that the implementation of individual criminal responsibility is possible at international level; and while the international criminal law specialists set their studies on the development of the jurisprudence of the courts on the principle of legality of crimes, it is not the same, in terms of the principle of legality of sentences .This study attempts to evaluate the sentences imposed by the courts and the criteria used to support them.

أثبت إنشاء المحكمتين الجنائيتين الدوليتين الخاصتين بيوغسلافيا السابقة ورواندا إمكانية إنفاذ المسؤولية الجنائية الفردية على المستوى الدولي. وفي الوقت الذي اتجه فيه دارسو القانون الدولي الجنائي إلى التركيز على تطور الاجتهاد القضائي لهاتين المحكمتين المتعلق مبدأ شرعية الجريمة، فإن مبدأ شرعية العقوبة حظي باهتمام أقل. وتهدف هذه الدراسة إلى محاولة تقويم تطبيق هذا المبدأ من خلال العقوبات المقررة من طرف المحاكم الجنائية الدولية الخاصة والمعايير المستخدمة في تقديرها.

La Mise en place des Tribunaux pénaux internationaux pour l’Ex-Yougoslavie et pour le Rwanda a prouvé que la mise en œuvre de la responsabilité pénale individuelle est possible sur le plan international. Alors que les spécialistes de droit international pénal insistent sur le développement de la jurisprudence à propos de la légalité des crimes, il n’en est pas de même, pour ce qui est du principe de légalité des peines .Cette étude tente d’évaluer les peines prononcées par ces tribunaux et les critères utilisés.
