One of the principles of the fight against corruption is the transparency of the procedures of the public service delegation. In this respect, the study aims to determine the extent of the efficiency of the Executive Decree 18-199, as a procedural regulation, to confer effectiveness on transparency provision, by investigating the extent to which the Algerian legislator succeeds in guaranteeing the transparency of procedures for the public services delegation, under the Executive Decree 18-199, In the context of compliance with national and international legal provisions in the prevention and fight against corruption, as legal sources of the Executive Decree. To answer the research question, analysis of the general direction of the legislator as well as a critical study of the texts of the executive decree on the prior announcement, the decisions on provisional allocation and appeals were conducted. As regards the need to modify articles 25, 26, 31, 35, 41 and 42 of the Executive Decree, we suggest a set of procedures.

تعدّشفافية إجراءات تفويض المرفق العمومي من أهم المبادئ الكفيلة بمكافحة الفساد وضرورة حتمية لجلب الاستثمار. لذا تهدف الدراسة إلى الوقوف على مدى تضمين المرسوم التنفيذي 18- 199-بعدّهتنظيما إجرائيا- النصوص الكفيلة بنقل شفافية إجراءات تفويض المرفق العمومي من التقنين إلى التمكين، من خلال التساؤل عن مدى فعالية أحكام المرسوم التنفيذي 18-199في ضمان شفافية إجراءات تفويض المرافق العمومية، وذلك في إطار احترام أحكام النظم القانونية الوطنية والدولية المعنية بالوقاية من الفساد ومكافحته باعتبارها مصادر قانونية للمرسوم التنفيذي. تضمنت الإجابة دراسة تحليلية للتوجه العام للمشرع، طبقا لمختلف قوانين مكافحة الفساد، بعدّهامصادر قانونية، سواء تاريخية (مادية) أو شكلية للمرسوم التنفيذي، أولا؛ وثانيا دراسة نقدية لنصوص المرسوم التنفيذي ذاته المعنية بشكليات ومضمون الإعلان المسبق، الإعلان عن قرارات المنح المؤقت وعن ممارسة حق الطعن. لنتوصل إلى ضرورة تعديل نصوص المواد 25، 26، 31، 35، 41و42من المرسوم التنفيذي، وقدمنا بصددها مجموعة اقتراحات إجرائية عملية.

La transparence des procédures de délégation des services publics est l'un des principes de la lutte contre la corruption. La présente étude vise donc à déterminer l’étendue de la capacité de décret exécutif 18-199, en tant que réglementation procédurale, de conférer l’effectivité aux dispositions de transparence, et ce, en s’interrogeant sur la réussite du législateur algérien de garantir la transparence des procédures de délégation des services publics, en vertu du décret Exécutif 18-19 , dans le cadre du respect des dispositions juridiques nationaux et internationaux en matière de prévention et de lutte contre la corruption en tant que sources juridiques du décret exécutif. En ce sens, nous présentons, dans un premier temps, une étude analytique de l'orientation générale du législateur, ensuite, une étude critique des dispositions du décret exécutif portant sur l'annonce préalable, sur les décisions d’attribution provisoire et sur les recours, cela en vue de montrer la nécessité de modifier les articles 25, 26, 31, 35, 41 et 42 du décret exécutif. Nous suggérons, enfin, un ensemble de procédures.
