The escalation of marital violence in Algeria and the danger it represents for family and society altogether has urged the legislator to reinforce the penal protection of the wife against the physical, psychological and financial abuse caused to her by her husband. The law n°15-19 brought important amendments in this respect while omitting the criminalization of sexual violence. In order to emphasize the importance of this subject, we have addressed the particularity and aspects of this protection by exhibiting the characteristics of the penal policy provided by the legislator in favor of the wife against the forms of conjugal violence. approved by the legislature for the wife against forms of domestic violence.

لقد أدى تزايد العنف الزوجي في الجزائر وخطورته على الأسرة والمجتمع، إلى تحرك المشرع نحو تعزيز الحماية الجزائية للزوجة ضد التعنيف الجسدي والنفسي والمالي الذي تتعرض له من زوجها، حيث جاء القانون 15-19 بتعديلات هامة بهذا الخصوص متناسيا تجريم العنف الجنسي ولإبراز أهمية الموضوع تناولت خصوصية ومظاهر هذه الحماية، من خلال عرض لمميزات السياسة العقابية والتجريمية التي أقرها المشرع للزوجة ضد أشكال العنف الزوجي.

L’escalade des violences conjugales en Algérie et le danger qu’ils représentent pour la famille et la société a contraint le législateur à renforcer la protection pénale de l’épouse contre les abus physiques, psychologiques et financiers que son mari lui fait subir. La loi n°15-19 a apporté d’importants amendements à cet égard omettant la criminalisation des violences sexuelles. Pour souligner l’importance de ce sujet, nous avons traité de la particularité et des aspects de cette protection à travers l’exposé des caractéristiques de la politique pénale prévue par le législateur en faveur de l’épouse contre les formes de violence conjugale.
