Foundations of Direct Execution of Human Rights Treaties

Abstract

English

For the implementation of human rights treaties by the internal judg and the individual’s adherence to the rights established therein, these treaties must be incorporated into the internal law of the state’s party to them. However, incorporation alone is not sufficient for these treaties to have their effects at the internal level, it requires that they must be implemented directly. The direct application of human rights treaties depends on the intention of parts of the treaty which is called the subjective foundation, on the preciseness of the treaty’s texts and on its satisfaction which is called the objective foundation.

The study has revealed that working with the subjective foundation constitutes an obstacle in front of the effectiveness of human rights treaties. On the other hand, the objective foundation has opened a new horizon on its direct application, like the possibility of applying economic, social and cultural rights.

لتطبيق اتفاقيات حقوق الإنسان من طرف القاضي الداخلي، وتمسك الأفراد بالحقوق المقررة فيها يجب أن تكون هذه الاتفاقيات مدمجة في القانون الداخلي للدول الأطراف فيها. إلا أن الإدماج وحده غير كاف   لترتب هذه الاتفاقيات آثارها على المستوى الداخلي، بل يتطلب ذلك أيضا أن تكون ذات تنفيذ مباشر. ويتوقف تحديد النفاذ المباشر لاتفاقيات حقوق الإنسان على نية أطراف المعاهدة وهو ما يعبر عنه بالأساس الذاتي،وعلى مدى دقة النصوص الاتفاقية وكفايتها بحد ذاتها، ويعبر عنه بالأساس الموضوعي.

وقد كشفت الدراسة أن العمل بالأساس الذاتي شكل عائقا أمام فعالية اتفاقيات حقوق الإنسان، في حين فتح الأساس الموضوعي آفاقا جديدة على صعيد التطبيق المباشر لها، كإمكانية تطبيق الحقوق الاقتصادية والاجتماعية والثقافية.

Pour une application des traités relatifs aux droits de l’homme par le juge interne et pour que les individus adhèrent à ces droits qui y sont établis, il faut que ses traités soient incorporés dans le droit interne des États parties. Mais l’incorporation seule n’est pas suffisante pour qu’ils aient leurs effets au niveau interne, ils exigent, également, d’être directement applicables. L’exécution directedes traités relatifs aux droits de l’homme dépend de l’intention des États parties de la convention exprimée par le fondement individuel, dépend aussi de la précision des dispositions et de son autosuffisance exprimés dans le fondement objectif.

L’étude a révélé que le travail avec le fondement subjectif était un obstacle devant l’efficacité des traités relatifs aux droits de l’homme, alors que le fondement objectif ouvrait de nouveaux horizons en terme d’application directe, comme la possibilité d’appliquer des droits économiques, sociaux et culturels
