It is not enough to expand the scope of the administrative judge’s intervention to enable him to further protect individual and collective fundamental freedoms, but it is necessary to enable him to have broader powers to perform his new functions in the best manner. First, administrative judgements are issued within a short space of time, in addition to giving him greater powers in the field of administrative investigation and giving him wider possibilities to intervene to raise points of law on his own initiative and even to dismiss and adjudicate more than the parties have requested if he deems it necessary and finally to give him the possibility of exercising prejudice to the unconstitutionality of laws.

لا يكفي توسيع مجال تدخل القاضي الإداري لتمكينه من حماية أكثر للحريات الاساسية الفردية والجماعية ولكن من الضروري تمكينه من صلاحيات أوسع لأداء مهامه الجديدة على أحسن وجه . ويكون ذلك اولا ان تصدر الاحكام القضائية الادارية في حيز زمني وجيز بالإضافة الى اعطائه صلاحيات أكبر في مجال التحقيق الإداري و اعطائه إمكانات أوسع للتدخل لإثارة نقاط قانونية من تلقاء نفسه ، بل حتى الفصل والقضاء بأكثر مما طلب الأطراف إن رأى في ذلك ضرورة وأخيرا إعطائه امكانية ممارسة الدفع المسبق بعدم دستورية القوانين.

Il ne suffit pas d’élargir le champ d’intervention du juge administratif pour lui permettre de mieux protéger les libertés fondamentales individuelles et collectives, mais il faut le doter de larges pouvoirs pour accomplir au mieux ses nouvelles missions. Cela se fait d’abord en rendant des décisions judiciaires administratives dans un laps de temps réduit en plus de lui donner des pouvoirs accrus en matière d’instruction et lui accorder la possibilité de relever des moyens d’office , bien qu’ils ne soient pas des moyens d’ordre public , lorsque le juge administratif estime que la décision qu’il doit rendre lui parait susceptible d’être fondée sur le moyen relevé d’office et statuer également « ultra pétita » sans que cela ait été nécessairement demandé par des parties et enfin lui donner la possibilité de transmettre une question prioritaire de constitutionnalité (Q P C) au conseil d’Etat
